When the president does declare a war, Congress usually gives him a list of powers in the National Defense Authorization Act that Congress might use to wage the hostilities. It then determines whether any specific use of those powers would contravene international law.
The administration has not used military force to date, so the question is whether any of the powers Washington has claimed would necessarily be “unreasonable, excessive, or unnecessary.” A military option might be a reasonable, reasonable measure for achieving that goal.
The National Defense Authorization Act is a broad law that is not an exhaustive list of all the means Americans might use in a future conflict against Syria. Even though President Trump did not take action on Wednesday night, the White House has asked Congress for its authorization to wage war, meaning that there are certain things Congress has to agree to even though Trump didn’t really win the war.
For example, President Trump asked a select committee on the House Armed Services Committee to put forward a plan to take out Syria’s chemical weapons. The president has not taken any action and, therefore, it would be difficult to take the congressional authority, if granted, to take action against the very same government responsible for the chemical weapons.
While presidents are allowed to declare war in order to justify a war-fighting operation, this authorizations is limited to certain actions against specific targets. This allows presidents to order airstrikes against a specific location in Syria, but not to target a specific person or group, which is what Syria has done in the last year.
