In 2013, the White House was asked to make recommendations on how to improve the Federal Election Commission’s enforcement against large political money in federal campaigns. Now, as the FEC continues to grapple with the new realities of the modern election cycle, it has received more than 3,400 requests for information over the past two years.
In the process of evaluating these complaints, the FEC investigated about 500 complaints from the public and others alleging violation of federal ethics law. The Commission is expected to make recommendations before the end of the year and then to take whatever actions it determines are appropriate, either through public hearings or new legislative or administrative proposals.
The top three complaints – the most serious – involved violations of the Hatch Act, which prohibits U.S. federal employees from engaging in partisan political activity; the McCain-Feingold campaign finance law; and the U.S. Campaign Finance Act, which prohibits candidates from coordinating with party committees.
The first two complaints focused on campaign finance laws, alleging that donations from lobbyists amounted to gifts from corporate shareholders, and that campaign spending by candidates, unions, and other groups violated the Constitution and the campaign finance laws. These complaints alleged violations that, while not necessarily illegal, may be subject to penalties under the Hatch Act. The third complaint, by a lobbyist for the Chamber of Commerce, involved violation of federal election laws. As part of one of the complaints, the Commission requested information on the “specific activities of the Chamber.”
Following the publication of a July 18 opinion by the Court of Appeals for the District of Columbia Circuit, the Department of Justice filed a petition for certiorari in the District Court for the District of Columbia, which then moved to intervene in the case. The United States argues that the case does not belong in a district court because the case presents issues of federal jurisdiction because it implicates political campaign laws. The United States challenges the complaint on jurisdictional grounds and on grounds that are not involved in the litigation at hand.
The Justice Department seeks to intervene only to make known to the court the Department’s intention to file a complaint in this case.
