The Federal Court of Appeal has declared a law that allows authorities to search your phone without a warrant unenforceable – and struck down a warrantless phone search law proposed by Senator John Faulkner to the federal Parliament.
In a ruling handed down in July, the court ruled the law is unlawful and in breach of fundamental principles of federal law. The court said that given that the Australian Security Intelligence Organisation (ASIO) already had a warrant to search the phone of an alleged paedophile, there was no need to allow it to access the phone from an internet-connected device.
The decision of the Federal Court was to be appealed to the Supreme Court – and would likely be reversed if, as appears likely, the appeal is dismissed.
