A former Navy SEAL from San Diego who suffered a traumatic brain injury while fighting in Iraq has filed a lawsuit claiming that a government program has prevented him from having a relationship with his family.
The suit filed on Monday alleged the “disastrous and unwanted consequences” of the government’s program to promote and treat post-traumatic stress disorder and traumatic brain injury. The lawsuit claims that the program, known as the TRICARE program, has been designed with a focus on the appearance of being successful at maintaining military duty rather than the reality of a former SEAL.
The lawsuit, which seeks damages up to $7 million, was filed in federal court in San Diego.
“It’s time for us to step up and make a change,” the suit stated.
“The TRICARE program is designed to make you look as if you did your job well and have a good record after being on military duty for the vast majority of your time in the service,” the lawsuit states. “The program was created to give the appearance of being in the best shape of your life at the end of deployed time; however, the truth is that you do not deserve this and have been damaged as a result.”
The lawsuit was filed by a Washington, D.C., attorney, Joseph Zawistowski. The suit describes how the government has encouraged those who have suffered traumatic brain injury to “show the enemy and protect the government” in exchange for health benefits. The suit further states that those who suffer from the disorder, in part, are “treated as if they were not truly suffering from brain injury.”
