It turns out, there is a huge difference between what the American Civil Liberties Union believes is true—that drugs are dangerous—and what the DEA considers to be true—that drugs aren’t dangerous.

In May 2014, the Center for Medical Progress released “The War on Drugs: How the New Drug War is Driving Up America’s Prison Population” a report claiming that “overuse of drugs by American citizens” and “the militarization of police force in communities across the country” had led to a “tremendous spike in the rate of federal drug arrests” in the years since 2001.

The following month, the ACLU released a follow up, “The War on Drugs: Federal Overreach and the Devastating Consequences,” noting “a disturbing rise in the number of Americans going to jail for drugs related offenses since the crack epidemic.”

Both reports focused on the “war on drugs,” however, the study in question was actually an analysis of the Drug Policy Alliance’s findings in January 2012—the same year a study by the Vera Institute of Justice found that the average age of Americans imprisoned for drug possession increased from 20.5 years to 29.9 years.

To be sure, both studies examined drug laws, specifically laws that allow police officers to search people’s homes and cars without a warrant as well laws that require people to undergo drug tests at the roadside, but in neither case did the ACLU’s report offer any data to back up the claims the study’s authors had made.
